Economic Freedom Fighters (EFF) leader Julius Sello Malema and member of Parliament Mbuyiseni Ndlozi are expected to appear that the Randburg Magistrates Court on Friday morning for their assault case.

EFF MP Ndlozi is expected to take the stand as the assault case against him and Malema resumes. The two are accused of assaulting a senior police officer Lieutenant-Colonel Johannes Venter at the funeral of Winnie Madikizela Mandela in April 2018.

Lat month, their application to have the case discharged was dismissed by the court. The leader of the EFF and parliament’s MP approached the court of the case to be dropped. Magistrate Leland Poonsamy said the state had proved that there is enough evidence for the matter to move forward.

The assault case is set to resume after it was postponed in May for judgement. At their last appearance the state had to close its case as the final witness was not present in court. EFF MP Mbuyiseni Ndlozi, instead, will be taking the stand and cross examined on Friday, said Afriform.

“The civil rights organisation, Afriforum, holds a watching brief in this case. Mbuyiseni Ndlozi will testify during the court proceedings on Friday,” said Afriforum campaign officer Reiner Duvange.  

Following Magistrate Poonsamy’s judgement on 3 June, the trial is set to proceed. The legal representative of Malema and Ndlozi said the pair are ready to testify.
