Student found guilty and expelled from Stellenbosch University over urinating incident

Stellenbosch University student Theuns du Toit has been expelled after being found guilty of contravening clauses of disciplinary code for students, according to spokesperson Martin Viljoen.

The university made an announcement on Thursday evening following the outcome of the disciplinary hearing which took place in June. This follows his suspension which stemmed from a video which trended on social media where Du Toit was captured urinating on the belongings of a fellow black student, Babalo Ndwayana.

In a statement on Thursday, the university said that the disciplinary hearing of Du Toit, after the urinating incident on at Huis Marais on May 15, was concluded on June 23. It said on Thursday the independent central disciplinary committee (CDC) found Du Toit guilty of contravening a number of clauses of the institution’s disciplinary code for students.

One of the clauses says no student shall, without good and lawful reason, wilfully engage in any conduct which adversely affects the University, any member of the University community, or any person who is present on the University campus at the invitation of the University.

“A student shall not act in a manner that is racist, unfairly discriminatory, violent, grossly insulting, abusive, or intimidating against any other person. The prohibition extends but is not limited to conduct which causes either mental or physical harm, is intended to cause humiliation, or which assails the dignity of any other person, premises, and property. A student shall not make use of, occupy, or enter any University premises without permission to do so.”

Viljoen said the findings convinced the Central Disciplinary Committee (CDC) to conclude that there was no alternative but to expel Du Toit with immediate effect from the university.
